TITLE I
SCOPE OF THE CODE OF ETHICS
ART. 1
DEFINITION OF ETHICS
Expert Ethics represents the principles and the
rules that all Experts shall scrupulously follow
in the practice of their profession.
ART. 2
CODE OF ETHICS EXTENSION
This Code provisions apply to all Experts, belonging
to all occupational and commodity categories.
ART. 3
COMPLIANCE WITH THE RULES
Experts shall comply with the ethical standards
in all sectors and spheres of their profession.
In complying with the rules the Expert shall respect
all non-encoded rules.
ART. 4
DISCIPLINARY MEASURES
Failure to comply with the rules, the obligations
and the prohibitions of the Code of Ethics, and
all actions or omissions considered inadequate for
the proper practice of the profession, are subject
to disciplinary measures.
TITLE II
GENERAL DUTIES OF THE EXPERT
ART. 5
TRUTH VERIFICATION
The Expert performs a social role of public utility
in the sphere of justice and therefore he/she has
the duty to ascertain the truth.
ART. 6
FREEDOM AND DIGNITY OF THE PROFESSION
Expert’s practice is based on the freedom
and dignity of the profession, Expert’s inalienable
right. The acceptance of expert tasks, also with
associate offices or the practice of the profession
in different places, requires the Expert to guarantee
service continuity.
ART. 7
EXPERT KNOWLEDGE
In his/her professional practice, the Expert shall
constantly comply with his/her technical-scientific
knowledge and with his/her professional experience,
having as a fundamental value the respect of the
citizens applying to him/her for the protection
of their rights. The Expert shall not submit to
whatever interests, orders or suggestions. The Expert
shall report any attempt to impose behaviors that
do not comply with the professional ethics.
ART. 8
EXPERT’S BEHAVIOR
Expert’s behavior, also beyond his/her professional
practice, shall be in accordance with the sector,
the office and people’s dignity, avoiding
to exercise the profession in sectors that are not
compatible with his/her professional dignity and
with his/her category reputation. The Expert with
public offices and political tasks shall not take
advantage of and misuse this power for his/her profession.
The Expert shall not look for clients through illegal
advertisement and brokers, or with false pretences.
ART. 9
PROFESSIONAL SECRECY
The Expert shall not make public comments about
clients’ problems and their personal situations.
In his/her publications, the Expert shall avoid
all allusions that may compromise the professional
secrecy. The Expert is the only one responsible
for his/her service; he/she will therefore inform
the collaborators about the obligation of professional
secrecy and about the rules of behavior included
in the Code of Ethics. In addition, the Expert shall
do the best to respect moral and professional obligations.
In no way, the Expert can sign to certify third
parties’ documents. The Expert shall use particular
caution when entering upon complicated and/or delicate
services relevant to subjects he/she is not proficient
in. If the service requires different qualifications,
the Expert can take advantage of the collaboration
of other experts and professionals, remaining in
any case the only one responsible for it.
ART. 10
EXPERT’S APPLICATION
In valuations, certifications and all other documents
the Expert shall be as scrupulous as possible, recording
correctly all the data and making reliable judgments.
ART. 11
PROFESSIONAL UPDATING
The Expert has a special mission to carry out, a
public service to guarantee, and in his/her profession
shall constantly keep up to date in order to guarantee
a proper service.
ART. 12
PROFESSIONAL FEES
Professional fees are a guarantee of professional
dignity and of service quality. The Expert shall
not apply improper fees or work without charge.
The Expert shall inform in advance the client about
the fee.
TITLE III
OFFICIALLY APPOINTED TECHNICAL
ADVISOR
ART. 13
RESPONSIBILITIES AND DUTIES OF THE OFFICIALLY APPOINTED
TECHNICAL ADVISOR
The officially appointed technical advisor collaborates
with the Judge in the general interest of justice.
In addition to what is provided by the existing
law and regulations, the officially appointed technical
advisor shall answer as completely as possible to
the questions of the Judge. In the technical report
the Expert shall comply with all regulations, taking
into consideration Code of Ethics provisions.
TITLE IV
GENERAL RULES OF BEHAVIOR
ART. 14
RELATIONSHIPS WITH THE CITIZEN
The Expert shall administer citizen’s interests.
The Expert shall devote himself/herself equally
to all people applying for a professional service.
The relationship with the public shall always be
inspired by politeness and cordiality, and shall
be cultivated correctly and scrupulously.
ART. 15
INFORMATION TO THE PUBLIC
Expert’s service, directly or indirectly intended
for the support of third parties’ commercial
activities, also under the form of articles and
mass media interventions, will open disciplinary
proceedings.
TITLE V
RELATIONSHIPS WITH COLLEAGUES
ART. 16
RELATIONSHIPS AMONG EXPERTS
The relationships among experts shall be inspired
by mutual respect and consideration, in order to
preserve the specific professional skills. The Expert,
taking the place of a previously designated colleague,
before the assignment shall ascertain that the professional
relationship was settled.
ART. 17
RECIPROCITY AND SOLIDARITY
The relationships among experts shall be inspired
by correctness and cordiality; they shall lend each
other mutual aid and assistance for the performance
of their professional duties. They shall collaborate
in order to make expert service always more efficient.
All agreements shall always be authentic and appropriate.
Obligations shall be inspired by total solidarity.
The Expert shall consider the work of each colleague
to be made in good faith. Before taking recourse
to legal action, possible disputes relevant to the
profession shall first be settled by the colleagues.
When unfairly attacked, the Expert shall always
have the possibility to rely on colleagues’
solidarity.
